Once you are arrested for driving under the influence, the arresting officer is required to confiscate your driver's license and issue a notice of suspension or revocation. It is vital to request a hearing within ten days of receiving the notice of suspension. Failure to request an Administrative License Hearings will result in an automatic driver's license suspension.

The length of a driver's license suspension varies. For a first offense, a license is suspended for four months. Every offense after the first in a ten year period will result in a one year suspension. California's Zero Tolerance Policy requires a one year driver's license suspension for drivers under the age of twenty-one with a blood alcohol level of .01 or higher.

Restrictive Driver's Licenses

California DMV license suspension does not necessarily mean that you cannot drive to and from work. Our attorneys have extensive experience helping people apply for and obtain restrictive driver's licenses. The request for a restrictive driver's licenses is separate from the DMV hearing. They must be made at a DMV field office after the suspension hearing.

Our attorneys are committed to helping people retain their driving privileges after a DUI arrest. We know how the system works and how to effectively challenge driver's license suspensions. In addition to handling DUI license suspension and restrictive driver's license applications, our attorneys have significant experience challenging traffic tickets related to moving violations.
